1. Scope of Application

These Terms of Sale apply to all services offered through the website www.stayonpro.com, operated by David Houdusse 2 Web EIRL under the brand name StayOnPro.

By placing an order, subscribing to a service, submitting a payment or using any StayOnPro service, the customer agrees to these Terms of Sale without reservation.

StayOnPro provides website creation, management, hosting, maintenance and related digital services for local service businesses, including landscaping, lawn care, outdoor service companies and other professional service providers.

2. Description of Services

StayOnPro offers managed website services designed to help local service businesses build a clear, professional and easy-to-contact online presence.

The main managed website offer may include, depending on the selected plan:

  • Creation and publication of a professional business website
  • Homepage, services, projects, about and contact structure
  • Copywriting based on the customer’s services, process and service area
  • Project gallery or before-and-after photo sections
  • Contact forms and quote request paths
  • Optional AI assistant to help visitors ask questions or describe their request
  • Domain name and hosting, when included in the selected offer
  • Basic SEO structure for services and local visibility
  • Security, backups and WordPress updates
  • Small content updates during the subscription period
  • Email-based support

StayOnPro may also offer a lighter basic business page option, designed to provide a simple professional presence inside the StayOnPro website. This basic option is separate from the full managed website plan and includes a more limited scope of service.

Each website or business page is created using information provided by the customer through a form, email, document or other agreed method. The customer is responsible for submitting accurate, complete and lawful information to allow proper service delivery.

3. Offers, Prices and Payment

Prices are displayed in US dollars unless otherwise specified. StayOnPro may offer different plans, including but not limited to:

  • Managed Website Plan: $99 USD per month, billed yearly at $1,188 USD per year.
  • Basic Business Page: starting at $149 USD per year, when this offer is available.

The details, inclusions and limitations of each offer are specified on the relevant sales page at the time of order.

Payment is made by credit or debit card through a secure payment processor such as Stripe. StayOnPro does not store full payment card details on its own servers.

Unless otherwise agreed in writing, payment is due in full at the time of order. For yearly billing, the full annual amount is payable upfront.

The subscription or service becomes active once payment has been confirmed and the customer has submitted the necessary information required to begin the project.

4. Subscription, Cancellation and Refund Policy

All payments are final once the service has started.

Because StayOnPro provides customized digital services, including website setup, content structure, design work, hosting configuration and project preparation, payments are generally non-refundable once the order has been confirmed and work has begun.

No refund will be issued, whether in full or prorated, in the following cases:

  • Cancellation requested by the customer after work has started
  • Failure by the customer to provide the required content or information
  • Customer dissatisfaction after delivery, provided the service was delivered according to the agreed scope
  • Lack of use of the website or service by the customer
  • Absence of leads, sales, rankings or business results

If the customer does not provide the required information, content, photos, logo, business details or access needed to complete the project, StayOnPro may pause the project until the missing elements are received. This does not entitle the customer to a refund.

If a recurring payment option is offered and expressly accepted by the customer, the customer may cancel future renewals according to the cancellation process provided. Cancellation stops future billing but does not refund payments already made for the current subscription period.

5. Delivery Timeline

Delivery timelines depend on the selected offer, the complexity of the project and the speed at which the customer provides the required information.

For a basic business page, StayOnPro aims to publish the page within approximately 7 business days after receiving full payment and all required information.

For a full managed website, delivery may require more time depending on the number of pages, services, project photos, content requirements and optional features such as the AI assistant.

Any delivery timeline is paused if the customer has not provided the necessary content, information, files, approvals or access required to continue the project.

StayOnPro may provide estimated delivery times, but these are not guaranteed deadlines unless expressly agreed in writing.

6. Customer Responsibilities

The customer is responsible for providing accurate and up-to-date information, including business name, logo, services, service area, project photos, contact details, legal information and any other content required for the website.

The customer confirms that all texts, logos, photos, videos, trademarks, reviews and other materials submitted to StayOnPro are either owned by the customer or used with proper authorization.

The customer must not submit unlawful, misleading, discriminatory, defamatory, offensive, fraudulent or infringing content.

StayOnPro is not responsible for delays, errors, incomplete pages or inaccurate information resulting from missing, incorrect or outdated content provided by the customer.

7. Content, Photos and AI Assistance

StayOnPro may assist with copywriting, page structure, service descriptions and website presentation based on the information provided by the customer.

If the customer provides limited information, StayOnPro may create draft content using reasonable assumptions, but the customer remains responsible for reviewing and validating all published content.

The optional AI assistant is designed to help visitors ask questions, describe their needs or understand the customer’s services. It does not replace the customer, does not provide professional guarantees and should not be relied upon as a definitive source of technical, legal, financial or safety advice.

StayOnPro is not responsible for business decisions made by visitors or customers based on interactions with the AI assistant.

8. Service Renewal

Unless otherwise stated, subscriptions are valid for the period indicated at the time of order.

For the managed website plan billed yearly, the subscription covers one year of service from the activation date or delivery date, depending on the offer terms.

Renewal may be manual or automatic depending on the payment option selected by the customer. If automatic renewal is enabled, the customer will be billed according to the recurring payment schedule accepted at checkout.

If the customer does not renew the subscription, StayOnPro may suspend hosting, support, updates, maintenance, AI assistant features or access to the website after the end of the paid period.

9. Maintenance and Updates

The managed website plan may include hosting, security checks, backups, WordPress updates and small content updates during the subscription period.

Small content updates may include minor text changes, replacement of photos, contact detail updates or limited service adjustments.

Major redesigns, new pages, advanced SEO campaigns, advertising management, custom development, complex integrations, large content rewrites or extensive strategy work are not included unless expressly stated in the selected offer or agreed separately in writing.

10. SEO, Leads and Business Results

StayOnPro may structure websites to support clarity, local visibility, search engine understanding and visitor action.

However, StayOnPro does not guarantee Google rankings, indexing speed, traffic volume, leads, quote requests, sales, revenue, customer acquisition or any specific business result.

The success of a website depends on many external factors, including competition, customer reviews, local demand, brand reputation, pricing, service quality, advertising, search engine algorithms and the customer’s own commercial activity.

11. Intellectual Property

The general structure, design system, templates, code, layouts, internal tools, processes and technical configuration used by StayOnPro remain the property of StayOnPro or its licensors.

Content provided by the customer, including logos, photos, business information and original customer-owned materials, remains the property of the customer.

Unless otherwise agreed in writing, the customer receives a right to use the website during the active subscription period. This right may be suspended or terminated if the subscription is not paid or renewed.

StayOnPro may display completed websites, screenshots or examples as part of its portfolio, marketing materials or demonstrations, unless the customer requests otherwise in writing.

12. Hosting, Domain and Access

When hosting is included in the selected offer, the website is hosted and technically managed by StayOnPro or its hosting provider.

When a domain name is included, the domain may be registered or managed by StayOnPro on behalf of the customer, depending on the offer and technical setup.

Administrative access, hosting access, source files, templates or technical configuration files are not automatically transferred to the customer unless expressly agreed in writing.

If the customer wants to move the website, transfer a domain or request an export, this may require a separate agreement, technical review and potential additional fees.

13. Suspension or Termination of Service

StayOnPro may suspend or terminate a service if:

  • The customer fails to pay or renew the subscription
  • The customer provides unlawful, abusive or infringing content
  • The customer misuses the service or attempts to compromise its security
  • The customer violates these Terms of Sale
  • Maintaining the service would expose StayOnPro to legal, technical or reputational risk

In the event of suspension or termination caused by the customer’s breach of these terms, no refund will be issued for the current subscription period.

14. Limitation of Liability

StayOnPro shall not be liable for technical issues caused by third-party services, including hosting providers, domain registrars, payment processors, email providers, plugins, APIs, analytics tools, AI systems, search engines or social media platforms.

StayOnPro shall not be liable for indirect or consequential damages, including loss of data, loss of revenue, loss of leads, loss of rankings, loss of business opportunities, business interruption, reputational damage or customer disputes.

In all cases, StayOnPro’s liability shall be limited to the amount paid by the customer for the service concerned during the current subscription period, unless otherwise required by applicable law.

15. Force Majeure

StayOnPro shall not be held liable for delays or failure to perform its obligations caused by events beyond its reasonable control, including but not limited to natural disasters, power outages, internet failures, cyberattacks, hosting outages, strikes, legal restrictions, illness, war, civil unrest or force majeure events recognized under applicable law.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of France, as the service provider is registered in France.

In the event of a dispute, the parties agree to first attempt to resolve the matter amicably.

If no amicable resolution can be found, the dispute may be submitted to the competent French courts, subject to any mandatory consumer protection rules that may apply.
